Public Records Requests

We are committed to openness and transparency. We respond to all public records requests in accordance with Oregon’s Public Records Law (ORS Chapter 192) and work to provide records as promptly as possible.

Public records help our community understand how we conduct the public’s business. At the same time, we are responsible for protecting the privacy of students and staff.

A public record is information that a public agency creates, owns, uses, or keeps as part of its work. Some records or portions of records are protected from disclosure by state or federal law. When that happens, we will remove the protected information and provide the rest of the record whenever possible.

What to include in your request

Please describe the records you are seeking as clearly and specifically as possible. Include:

  • Your name and contact information
  • The subject of the records
  • A specific date or date range
  • Names of people, programs, or departments associated with the records
  • Any relevant contract, project, solicitation, or reference number
  • Whether you prefer electronic copies, paper copies, or an opportunity to inspect the records

A focused request helps us locate records efficiently and may reduce processing time and cost. Staff may contact you if clarification is needed.

Fees

Oregon law allows public agencies to charge for the actual cost of fulfilling a public records request. These costs may include staff time, legal review, copying, postage, and other necessary expenses.

The first 30 minutes of staff time are free. If your request will take longer, we will send you a written cost estimate before continuing. Payment is required before we complete the full request.

You may ask for the fee to be reduced or waived if releasing the records would primarily benefit the general public. We review each fee waiver request individually and in accordance with Oregon law.

What to expect

We will acknowledge receipt of a written request within five business days or complete its response within that period.

After acknowledging the request, we will:

  • Determine whether it is the custodian of the requested records;
  • Locate and review responsive records;
  • Identify information that must or may be withheld under applicable law;
  • Provide a fee estimate when appropriate; and
  • Provide the records or a reasonable estimated completion date.

Response times depend on the scope and complexity of the request, the volume and location of responsive records, the need for legal review, and staff availability. We will communicate with the requester if additional time is needed.

Student and program records

Looking for records for an individual student or child? Please do not use the public records request form. Student education records are protected by state and federal privacy laws and must be requested through a separate process.

Records held by local school districts

We are a separate public agency and do not maintain all records belonging to school districts within Clackamas County. Requests for records created or maintained by a local school district should be submitted directly to that district.
